“Deliverables” refers to all drawings, models, files, documentation, and other outputs produced by the Company for the Client.
“Project” refers to a specific scope of work agreed upon between the Company and the Client.
2. Services Offered
The Company provides the following professional technical services:
- AutoCAD 2D Drafting & Technical Drawing
- Building Information Modeling (BIM) — Revit, Navisworks, and related platforms
- Architectural, Structural, MEP, and Civil Drawing Services
- 3D Modeling and Visualization
- Shop Drawings and Fabrication Drawings
- As-Built Drawings and Site Documentation
- CAD Conversion — PDF to CAD, Hand Sketch to CAD
- Clash Detection and Coordination Services
- BIM LOD 100 to LOD 500 Modeling
- Custom CAD & BIM consulting and project-based work
The scope of services for each project will be defined in a separate Project Agreement, Proposal, or Statement of Work (SOW) issued by the Company.
3. Engagement & Project Agreement
All projects are initiated upon the Client’s written acceptance of the Company’s proposal or quotation. Work will commence only after:
- Signed project agreement or confirmed purchase order
- Receipt of the agreed advance payment or deposit (where applicable)
- Receipt of all necessary input files, data, reference drawings, and project briefs from the Client
Any verbal commitments must be confirmed in writing to be considered binding. The Company reserves the right to decline any project at its sole discretion.
4. Client Responsibilities
The Client agrees to:
- Provide accurate, complete, and timely input files, references, specifications, and instructions required for the project
- Appoint a designated point of contact for communication and approvals
- Review and provide feedback on submitted deliverables within the agreed review period
- Notify the Company promptly of any changes, corrections, or additions to the scope of work
- Ensure that all materials provided to the Company (drawings, files, data) do not infringe upon any third-party intellectual property rights
The Company shall not be liable for errors, delays, or deficiencies arising from incomplete, inaccurate, or late input provided by the Client.
5. Revisions & Change Orders
Each project proposal clearly outlines the number of included revision rounds. The following conditions apply:
- Revisions within the agreed scope and quantity are included at no additional charge
- Revisions beyond the included rounds, or changes that alter the original scope, will be treated as Change Orders and billed separately
- Scope changes requested after work has begun may impact timelines and costs
- All change orders must be approved in writing before work proceeds
The Company will notify the Client in writing when a revision request constitutes a scope change.
6. Delivery & Timelines
Project timelines are estimated at the time of proposal and are subject to:
- Timely provision of all required input from the Client
- Prompt review and approval turnarounds by the Client
- The complexity and volume of the work
The Company will make all reasonable efforts to meet agreed deadlines. However, delivery dates are estimates and not guarantees unless explicitly stated as fixed deadlines in the written agreement.
Rush or expedited project requests may be accommodated at an additional fee, subject to availability.
7. Payment Terms
7.1 Fees & Invoicing
All fees are outlined in the project proposal or quotation. Invoices are issued upon project milestones or completion as agreed.
7.2 Advance Payment
The Company may require a deposit (typically 30–50% of the total project value) before commencing work, as specified in the project agreement.
7.3 Payment Due
Full payment is due within the number of days specified in the invoice (typically 7–14 business days from invoice date), unless otherwise agreed in writing.
7.4 Late Payments
Overdue invoices may be subject to a late payment fee. The Company reserves the right to suspend or withhold delivery of final files until all outstanding payments are received.
7.5 Currency
Unless otherwise specified, all fees are quoted and payable in [USD / PKR / your preferred currency]. Currency conversions are the Client’s responsibility.
8. Intellectual Property & Ownership
Upon receipt of full and final payment:
- The Client receives full ownership and usage rights to the final Deliverables produced specifically for their project
- The Company retains the right to use project work (in anonymized or generalized form) for portfolio, marketing, and promotional purposes, unless the Client requests confidentiality in writing
Until full payment is received, all Deliverables remain the intellectual property of the Company. The Client may not use, distribute, reproduce, or share any Deliverables until payment is cleared.
The Company’s proprietary templates, workflows, custom blocks, libraries, and processes remain exclusively the property of the Company and are not transferred to the Client.
9. Confidentiality
The Company treats all Client data, files, project details, and business information as strictly confidential. We will not disclose, share, or sell Client information to any third party without explicit written consent, except where required by law.
Clients may request a Non-Disclosure Agreement (NDA) before project commencement. The Company is willing to sign NDAs for sensitive or proprietary projects.
10. Accuracy & Warranties
The Company uses professional-grade software, experienced drafters, and quality control processes to deliver accurate and technically sound work. However:
- The Company does not warrant that Deliverables are free from all errors or omissions
- Deliverables are prepared based on the information provided by the Client; the Company cannot guarantee accuracy if input data is incorrect or incomplete
- All structural, civil, and engineering drawings produced by the Company are for drafting and coordination purposes only and do not substitute for stamped or licensed engineering certifications unless explicitly stated
Clients are responsible for verifying Deliverables against their project requirements and applicable codes before use in construction or permitting.
11. Limitation of Liability
To the maximum extent permitted by law, the Company’s total liability to the Client for any claim arising out of or related to the services shall not exceed the total fees paid by the Client for the specific project giving rise to the claim.
The Company shall not be liable for any indirect, incidental, consequential, or special damages, including but not limited to loss of profits, loss of data, or construction errors resulting from the use of Deliverables.
12. Termination
12.1 By the Client
The Client may terminate a project at any time with written notice. Payment will be due for all work completed up to the termination date, plus any non-recoverable expenses. The deposit is non-refundable.
12.2 By the Company
The Company may terminate a project if the Client breaches these Terms, fails to make payment, or engages in conduct that makes it impossible to perform the work. In such cases, payment for work completed remains due.
12.3 Effect of Termination
Upon termination, all licenses granted to the Client are revoked until outstanding payments are settled.
13. Third-Party Software & Standards
The Company uses industry-standard software including Autodesk AutoCAD, Autodesk Revit, Navisworks, and other BIM/CAD platforms. File formats are delivered as agreed in the project scope (e.g., .dwg, .rvt, .ifc, .pdf).
Software licensing compliance for any software provided to or requested by the Client is the sole responsibility of the Client.
14. Governing Law & Dispute Resolution
These Terms and Conditions shall be governed by and construed in accordance with the laws of [Your Country/State/Province]. Any disputes arising from these Terms or the services provided shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration or the courts of competent jurisdiction in [Your City/Jurisdiction].
